Copyright trolls have long been accused by file-sharers of intimidation and extortion, but now it seems that such complaints are not one-sided: even the American government filed a criminal case against Prenda Law’s principals.

A class action lawsuit was filed in a federal court on behalf of alleged copyright infringers, who accuse a group of copyright holders, lawyers, and torrent monitoring experts of being involved in “extortion conspiracy.” The lawsuit centers around Clear Skies Network. The latter sued alleged uploaders of the movie “Good Kill” over copyright infringement. Like in many other similar cases, copyright holders there cooperated with lawyers and BitTorrent monitoring experts to present their case. One of the defendants was a 62-year-old woman, who is now fighting back – not only for herself, but also on behalf of other targets that are in the same position.

She described in her complaint that she was repeatedly threatened and intimidated with six figures amount in statutory damages, while the trolls asked her to settle for only a few thousand. The woman also complained about various other allegations including false statements. Finally, she pointed out that the trolls might have purposefully operated a honeypot where they themselves distributed the copyrighted content before its official release.

It turned out that the group of copyright holders used monitored torrents and associated IP-addresses as the base evidence for lawsuits all over the United States, continuously relying on the same monitoring outfit whose evidence was insufficient to prove infringement. The targeted file-sharers believe that instead of protecting copyrights, the moviemakers and other parties involved in the conspiracy just want to generate a steady income flow from such settlements through exploitation of the court system. In other words, the copyright infringement was used as an extortion mechanism.

The woman claimed that such extortion practice led to her physical and emotional distress, and she is going to set the record straight by suing the copyright trolls back. She and other potential members of the class action lawsuit ask for actual monetary damages as well as punitive damages.
